TITLE 1 - PRELIMINARY PROVISIONS
E.C. (1)01. The San Andreas Electoral Division is recognized as the primary authority presiding over the fair enforcement of the San Andreas Electoral Code. The Electoral Division, overseen by the Chief Electoral Officer are put in charge of any investigations into violations of this code, they will report their findings directly to the Governor of San Andreas.
E.C. (1)02. Electoral Officers are to submit a declaration under oath as a commitment to tell the truth in the performance of their duties. If the official is later found to have lied whilst bound by the commitment, he/she is charged with Corruption of Public Duty as defined in the Penal Code under PC 609.
E.C. (1)03. (a) The San Andreas Senate consists of 11 Senators, who are elected at once, once every 4 months. The people of San Andreas get one vote per spot. (b) The Los Santos City Council consists of 8 council members, who are elected at once, once every 4 months. The people of Los Santos get one vote per district.
E.C. (1)04. Elections will commence once every 4 months, unless theyβre called for by the Chief Electoral Officer, on behalf of the Governor. Pre-quarter elections are only called if 4 or more Senators/Councilmembers have been found unfit to discharge their duty, have been removed from office, or resigned from their position.
TITLE 2 - PROCEDURE
E.C. (2)01. Pre-election phase (a) The Chief Electoral Officer announces the upcoming elections. (b) The supporting documentation for that election is released by the Electoral Division. (c) Candidates write their application, which they then forward to the Chief Electoral Officer. (d) Applications are reviewed by the Electoral Bureau and processed. (e) The candidate list is published by the Electoral Bureau.
E.C. (2)02. Campaigning phase (a) Chief Electoral Officer announces the start of the campaigning phase. (b) Candidates start their campaign by disclosing their manifesto. (c) The candidates are invited to a closing debate.
E.C. (2)03. Voting phase (a) Chief Electoral Officer announces the start of the voting phase, calling a halt to the campaigning. (b) The people of San Andreas get a total of seventy-two (72) hours to cast their votes. (c) After the ballots close, the Electoral Division has forty-eight (48) hours to count and verify the votes cast, after which they disclose the results.
TITLE 3 - FINANCES
E.C. (3)01. (a) Every candidate who submits their application is to raise $100.000 as a deposit payment to the Electoral Division.
E.C. (3)02. Candidates are only allowed to receive limited, one-time amounts from the following parties: (a) Registered political party ($100.000). (b) Private citizen of San Andreas ($25.000). (c) Businesses, Unions, or other special interest groups ($50.000).
E.C. (3)03. (a) Candidates are to keep records of the received donations; these records are to be accessible by the Electoral Division at all times. (b) Failing to keep, tampering with, or fraudulently keeping the aforementioned records will be punished with charges of PC 513. Fraud, as defined in the Penal Code.
TITLE 4 - ETHICS
E.C. (4)01. (a) Candidates and their staff are to maintain the highest standards possible, as they serve an exemplary function.
E.C. (4)02. (a) Candidates are expected to have no felonies or recent misdemeanors on record. Case-by-case exceptions may be made at the Chief Electoral Officerβs discretion.
E.C. (4)03. (a) Candidates are to show no disrespect to one another during the entire electoral process, this includes but is not limited to: advertisements, interviews, manifestos, etc.
TITLE 5 - OFFENSES
Title 5 covers all offenses relating to the electoral process, which are not included in the Penal Code of San Andreas, with statutes 501 through 504.
TITLE 6 - DISPUTES
E.C. (6)01. (a) Election disputes are inherent to elections. Challenging an election, its conduct, or its results should, however, not be perceived as a reflection of weakness in the system, but as proof of the strength, vitality, and openness of the political system.
E.C. (6)02. (a) The Electoral Division of San Andreas shall have jurisdiction over any civil action related to the execution of an election. Their findings are presented to the Chief Electoral Officer and the Governor upon completion.
E.C. (6)03. (a) Decisions made by the Electoral Division are final and cannot be appealed, unless theyβre taken to the Superior Court of San Andreas.
TITLE 7 - ORGANIZATIONS
E.C. (7)01. Political parties (a) Political parties recognized by the Electoral Bureau are listed in addendum I of the San Andreas Electoral Code. (b) Only those listed are to be represented during the elections; every other candidate is considered to be independent.
(c) Registering a party: For a party to be recognized, it must file for a declaration of recognition. This is only granted to the parties that uphold the highest standards of ethics and professionalism. Requirements: -$250,000/year registration fee, which is to be raised during a public fundraiser. -At least 5 active members. -A party headquarters in a respectable area of urban or rural San Andreas. -Internal elections to select party officials, once every 12 months.
E.C. (7)02. Public agencies (a) Public agencies are prohibited from endorsing a candidate either internally or externally. This includes: appearing during campaigning events, wearing campaign material, making campaign donations, and advocating for the candidate.
TITLE 8 - CRITERIA
E.C. (8)01. (a) Candidates are to meet the following criteria to be considered for a spot in the elections: -A candidate must reside in the state of San Andreas for at least 20 years. -A candidate must be at least 30 years of age. -A candidate must be clear of prior felonies and misdemeanors. -A candidate must be registered with a party, or be a registered independent. -A candidate must uphold the highest standards.
