Addendum I. County Charter

Preamble This document is a summary addendum for convenient viewing of the County Charter of Los Santos. Administrative Districts are defined in Addendum V. All powers and authorities of agencies in this document are included in Addendum IV, Section.

Section 1. The Jurisdictions of the Los Santos County Government shall be: a) Property management rights for all hospitals, medical centers, clinics, or other healthcare institutions that are not privately owned, within the borders of the Administrative District of Los Santos County, which are not under the jurisdiction of a City or a Township. b) Manage and run a Department of Public Health, which shall report to the Governor of San Andreas and shall have: -The power to regulate, issue, and create medical licenses for practice in the Administrative Districts of Los Santos County. -The power to regulate health codes and inspect facilities for health safety. -The power to issue health emergencies and establish triage facilities where necessary.

c) Manage and run a Department of Medical Examiner-Coroner, which shall report to the Governor of San Andreas and shall have: -The power to investigate deaths within the State of San Andreas. -The power to petition prosecutors to press death-related criminal charges. The power to utilise sirens, and red and amber front- and rear-facing lights when an incident requires immediate response.

Addendum II. City Charter

Preamble This document is a summary addendum for convenient viewing of the City Charter of Los Santos. Administrative Districts are defined in Addendum V.

Section 1. The Jurisdictions of the Los Santos City Government shall be:

  1. Property management rights for all hospitals, medical centers, clinics, or other healthcare institutions that are not privately owned, within the borders of the Administrative District of the Greater Los Santos Area.

  2. Property management rights for Los Santos City Hall, Los Santos Administration Building and all energy resource sites, quarries, and oil fields, which are within the boundaries of the Administrative District of the Greater Los Santos Area.

  3. Property management rights for all energy resource sites, quarries, and oil fields, which are not privately owned, within the borders of the Administrative District of the Greater Los Santos Area.

  4. The power to retain a State Bar-licensed attorney in the position of City Attorney to act as defense counsel in criminal matters, and general counsel in civil matters on behalf of the Los Santos City Government.

  5. The power to write contracts with the Mayor ofLos Santos' signature, which may be reviewed and contested by the City Council if deemed necessary.

  6. The power to appropriate funds within contracts with the consent of the los Santos City Council.

  7. The power to issue and regulate firearms licenses.

  8. The power to issue Business Code and Commercial Vehicle Code fines, issue licenses, and regulate business.

  9. The power to impound vehicles.

  10. Collection of appropriate license fees as determined by the City.

Sec. 2. The Jurisdictions of the Los Santos District Attorney shall be:

  1. Prosecution of criminal charges in the Criminal Division of the Superior Court of San Andreas on behalf of The People of Los Santos.

  2. Representation of Los Santos in all Courts and divisions of courts in San Andreas in all criminal proceedings and cases.

  3. Responsibility to enter nolle prosequi declarations in the interest of The People of San Andreas.

  4. The power to reduce, negotiate, or pursue charges at will if in the public interest.

  5. The power to investigate allegations of criminal misconduct brought against any government employee.

Sec. 3. The Jurisdictions of the Los Santos Public Defender shall be:

  1. Provide legal defense services, free of charge, to criminally accused persons in the Criminal Division of the Superior Court of San Andreas.

Addendum III. Agencies of the State of San Andreas

Preamble This document is a summary addendum for convenient viewing of the different jurisdictions of the government agencies of the State of San Andreas. All powers and authorities of agencies in this document are included in Addendum IV, Section.

Section 1. The San Andreas State Government, hereinafter referred to as the "SAGOV" or the "State Government," shall constitute the primary legislative and executive body of the State of San Andreas and shall operate under the authority of the Governor of San Andreas.

(a) The power to write contracts with the signature of the Secretary of State, which may be reviewed and revoked by the Governor of San Andreas. (b) The power to embolden the Governor to make at-will changes to any County of Los Santos department and/or City of Los Santos Department. (c) The power to manage, under the power of the seal of the Governor, if necessary, other departments/bureaus/agencies that are within the jurisdiction of the State, or where deemed necessary, the County of Los Santos and/or The Greater Los Santos Area. (d) The power to retain a State Bar-licensed attorney in the position of State Attorney to act as defense counsel in criminal matters, and general counsel in civil matters on behalf of the State Government. (e) Property management rights for the official Governor's Residence. (f) The Lieutenant Governor may permit the establishment of an investigatory committee with the power to subpoena and have access to records not normally accessible to the public to report on issues and make recommendations to the Governor's Office. (g) The power to possess the authority to issue and enforce licensing requirements and, where authorized by law, suspend, seize, deny, or recommend the revocation of licenses, permits, or certifications to the appropriate governmental authority. (h) The power to impound vehicles. (i) The State Department shall be led by the Secretary of State and report to the Governor. (j) The Treasury Department shall be led by the State Treasurer and report to the Governor. (k) The power to appropriate funds to all agencies within the State with the consent of the State Legislature.

Sec 2. The San Andreas Highway Patrol, hereinafter referred to as the "SAHP" or the "State Highway Patrol," shall constitute the primary municipal law enforcement agency of the State of San Andreas and shall operate under the authority of the Executive Branch of the State of San Andreas. The SAHP shall employ duly appointed Peace Officers in accordance with the Constitution, Penal Code, and laws of the State of San Andreas. The Jurisdictions of the San Andreas Highway Patrol shall be: (a) The San Andreas Highway Patrol shall operate as a State Agency and report directly to the Governor of San Andreas, who shall exercise supervisory and administrative authority over the agency. (b) The SAHP shall possess law enforcement jurisdiction throughout the incorporated boundaries of the State of San Andreas, where it shall not conflict with the jurisdiction of any other agency, and shall serve as the principal agency responsible for the preservation of public order, enforcement of law, and protection of life and property within the State. (c) The power to enforce all State-level regulatory codes, including but not limited to the licensing and business codes; Commercial Vehicular Codes; Election Codes; Aviation Codes; Firearms licensing and regulatory provisions; Any additional State Codes enacted or designated for enforcement by the State Government. (d) The power to issue licenses, regulate licensed activity, and enforce compliance with all applicable State licensing requirements. (e) The power to conduct enforcement actions relating to commercial vehicles, including inspections, citations, and regulatory compliance measures. (f) ~~The power to regulate firearms licensing and enforce firearms-related provisions as defined by State law and the Penal Code.~~ (g) The power to patrol the State where its jursdiciton is defined, and may: Conduct traffic stops, speed enforcement, and checkpoint operations on highways and rural areas; (h) Responding to incidents and calls for service within the State where its jurisdiction is defined, and ma yassist, if called for, other Law enforcement agencies, whether state wide or local; (i) Exercising full law enforcement authority within the State. (j) The San Andreas Highway Patrol shall hold primary jurisdiction over all State-owned properties and facilities, with exception to the State Penitentiary. (k) The San Andreas Highway Patrol shall hold secondary jurisdiction within the Administrative District of the City of Los Santos Area, where primary jurisdiction remains with the Los Santos Police Department and/or The Los Santos Sheriff’s Department, except where otherwise authorized by law or directive. (l) The power to respond to and assist in law enforcement operations across the State of San Andreas, and when requested by, or in coordination with, the Los Santos Police Department and/or Sheriff’s Office. (m) The power to investigate and enforce all felonies and misdemeanors related to Election Code violations, Licensing and regulatory offenses; Aviation-related offenses; Commercial vehicle violations; Specific firearms-related offenses as defined by the Penal Code. (n) The power to carry and utilize standard law enforcement equipment, including sidearms, batons, and chemical spray, in accordance with State policy. (o) The power to carry, maintain, and utilize firearms otherwise prohibited by the Penal Code.

Sec. 3. The San Andreas Deaprtment of Forestry and Fire Protection, hereinafter referred to as the "SanFire" or the "State Fire Department" shall operate under the authority of the Governor of San Andreas. The SanFire shall employ duly appointed Peace Officers in accordance with the Constitution, Penal Code, and laws of the State of San Andreas.

The Jurisdictions of the San Andreas Department of Forestry and Fire Protection shall be:

  1. Property management rights for all buildings leased to SANFIRE.

  2. Right to manage, maintain, and control the Fire Code of San Andreas, with consent of the State Legislature, and final approval of the Governor.

  3. Right to enforce the Fire Code of San Andreas.

  4. The power to revoke business licensing for businesses in violation of the Fire Code. The power to investigate all fire code related offenses.

  5. Primary jurisdiction over the entire County of Los Santos in all matters pertaining to Forestry and Fire Protection.

  6. To provide firefighting and medical services at no charge to all residents and visitors of San Andreas, and may not deny any person this service.

  7. Is a Law Enforcement Agency employing Peace Officers in accordance with the Penal Code and the Peace Officer Standards and Training.

  8. The power to impound vehicles violating (11)04. Parking Violation, for vehicles creating an obstruction or hazard during the excreting of SANFIRE duties.

  9. Arrest persons for felonies or misdemeanors relating to the Fire Code, as well as Penal Code 103, 104, 106, 108, 109.

  10. The power to carry, maintain, and utilize firearms otherwise prohibited by the Penal Code.

  11. The power to close roads or restrict access to public facilities for health and safety reasons.

  12. To operate checkpoints for health and safety reasons.

Sec. 4. The Jurisdictions of the Judiciary of San Andreas shall be:

  1. Property management rights for all court houses leased to the Judiciary of San Andreas by the State of San Andreas.

  2. Right to manage, maintain, and control all warrant policies and warrant authorization agreements with State Agencies et al., including surveillance warrants and other specialty warrants.

  3. The power to issue an injunction with appropriate legal justification, including district or gang injunctions. This also includes injunctions and actions against State Agencies, County Agencies,s and County of Blaine Government Agencies.

  4. Collection of appropriate court fees as determined by the Supreme Court.

  5. The power to regulate the admission of attorneys to practice law before the state court system.

  6. The power to revoke bar licenses and regulate attorney membership in the state.

  7. The power to investigate attorney misconduct in relation to the Attorney Oath and the Attorney Rules of Professional Conduct.

  8. Collection of appropriate license fees as determined by the State.

  9. Maintain a State Bar Association to administer the day-to-day operations of managing state bar members and applicants.

Addenda IV. Definition of Jursdictions

Preamble This document is a summary addendum for convenient viewing of the different jurisdictions of the government agencies of the County and City of Los Santos. This document contains the relevant powers and authorites for all agencies within the State as pretained in Section 3.

Sec 1. The Los Santos County Sheriff's Department, hereinafter referred to as the "LSSD" or the "Sheriff's Office," shall constitute the primary municipal law enforcement agency of the County of Los Santos and shall operate under the authority of the Executive Branch of the State Government of San Andreas. The LSSD shall employ duly appointed Peace Officers in accordance with the Constitution, Penal Code, and laws of the State of San Andreas.

The Jurisdictions of the Los Santos County Sheriff’s Office shall be:

(a). The LSSD shall possess municipal law enforcement jurisdiction throughout the incorporated boundaries of the County of Los Santos and shall serve as the principal agency responsible for the preservation of public order, enforcement of law, and protection of life and property within the County. (b) The LSSD shall be charged with enforcing the Constitution, statutes, ordinances, regulations, and lawful directives of the State of San Andreas and the County of Los Santos insofar as such enforcement falls within its lawful authority. (c) The LSSD shall exercise responsibility for patrol operations, criminal investigations, traffic enforcement, public safety operations, emergency response, crime prevention initiatives, and such other law enforcement functions as may be prescribed by law. (d) The LSSD shall retain administrative authority over all police headquarters, stations, substations, training facilities, detention facilities, administrative offices, communications infrastructure, equipment, records, evidence repositories, and other assets assigned to or maintained for the operation of the Department unless otherwise provided by law. (e) Nothing contained herein shall be construed to diminish, restrict, impair, or otherwise alter the lawful authority, responsibilities, or operational authority of the Los Santos Police Department except as expressly provided by law. (f) Nothing contained herein shall prohibit or diminish the lawful exercise of concurrent authority by the San Andreas Highway Patrol, The Los Santos Police Department or any other lawfully constituted law enforcement agency operating pursuant to the laws of the State of San Andreas.

The Los Santos Police Department, hereinafter referred to as the "LSPD" or the "City Police Department," shall constitute the primary municipal law enforcement agency of the City of Los Santos and shall operate under the authority of the Executive Branch of the City Government of Los Santos. The LSPD shall employ duly appointed Peace Officers in accordance with the Constitution, Penal Code, and laws of the State of San Andreas.

The Jurisdictions of the Los Santos Police Department shall be: (a) The LSPD shall possess municipal law enforcement jurisdiction throughout the incorporated boundaries of the City of Los Santos and shall serve as the principal agency responsible for the preservation of public order, enforcement of law, and protection of life and property within the City. (b) The LSPD shall be charged with enforcing the Constitution, statutes, ordinances, regulations, and lawful directives of the State of San Andreas and the City of Los Santos insofar as such enforcement falls within its lawful authority. Sec 3.

All State, County, and City Agencies within the State of San Andreas shall have the power to, under the authority of the Seal of the Governor, to:

(a) All state, county, and city law enforcement agencies and their duly sworn Peace Officers shall possess the authority to investigate criminal offenses, collect and preserve evidence, conduct lawful searches and seizures, execute warrants, interview witnesses, conduct criminal intelligence operations, and prepare matters for judicial proceedings and prosecution.

(b) All state, county, and city law enforcement agencies shall possess the authority to detain, cite, arrest, transport, process, and otherwise take lawful enforcement action against persons reasonably suspected of violating the laws of the State of San Andreas or the ordinances of the City of Los Santos.

(c) All state, county, and city law enforcement agencies shall possess the authority over the temporary detention, custody, booking, transportation, and processing of prisoners lawfully committed to their care.

(d) All state, county, and city law enforcement agencies shall possess the authority to issue citations, administrative penalties, fines, notices of violation, and such other enforcement instruments as may be authorized by law.

(e) All state, county, and city law enforcement agencies shall possess the authority to impound, tow, seize, store, and otherwise take custody of vehicles where authorized by law, including vehicles constituting a hazard, obstruction, evidentiary interest, or violation of applicable traffic and vehicle regulations.

(f) All state, county, and city law enforcement agencies and their sworn Peace Officers shall possess the authority to carry, maintain, deploy, and utilize firearms, less-lethal weapons, specialized equipment, and other law enforcement tools authorized by law and departmental regulation.

(g) All state, county, and city law enforcement agencies shall possess the authority to enforce licensing requirements and, where authorized by law, suspend, or recommend the revocation of licenses, permits, or certifications to the appropriate governmental authority.

(h) All state, county, and city law enforcement agencies shall possess the authority to establish security zones, safety perimeters, restricted-access areas, evacuations, and temporary roadway closures where reasonably necessary to preserve public safety, protect life and property, facilitate emergency operations, or support criminal investigations.

(i) All state, county, and city law enforcement agencies shall possess the authority to establish and operate lawful checkpoints, inspection points, traffic control operations, and public safety screening measures as authorized by law.

(j) All state, county, and city law enforcement agencies shall possess the authority to provide security, crowd management, traffic control, and public safety services for demonstrations, public assemblies, parades, civic functions, special events, and other lawful gatherings occurring within their jurisdiction.

(k) All state, county, and city law enforcement agencies shall possess the authority to request, provide, coordinate, or participate in mutual aid operations, interagency task forces, regional enforcement initiatives, emergency management operations, and joint criminal investigations with other governmental agencies.

(l) All state, county, and city law enforcement agencies shall maintain and administer official law enforcement records, evidence repositories, criminal intelligence systems, investigative files, departmental databases, and other records under its lawful custody and control, subject to applicable law.

(m) All state, county, and city law enforcement agencies shall possess the authority to protect critical public infrastructure, governmental facilities, public utilities, transportation systems, and other assets deemed essential to public safety within its jurisdiction.

Addendum V. Definition of Administrative Districts

Addendum VI. The Governor of San Andreas

Sec 1. The supreme executive power of this State is vested in the Governor. The Governor shall see that the law is faithfully executed.

Sec __ The Lieutenant Governor shall have the same qualifications and powers as the Governor at the discretion of the Governor. The Lieutenant Governor is President of the Senate.

Sec __ The Governor may require executive officers and agencies and their employees to furnish information relating to their duties.

Sec __ (a) Unless the law otherwise provides, the Governor may fill a vacancy in office by appointment until a successor qualifies. (b) Whenever there is a vacancy in the office of the Lieutenant Governor, Secretary of State, Treasurer, or Attorney General, the Governor shall name a person to fill the vacancy who shall take office and assume all duties upon taking the oath of office.

Sec __ Authority may be provided by statute for the Governor to assign and reorganize functions among executive officers and agencies and their employees, other than elective officers and agencies administered by elective officers.

Sec __ The Governor is commander in chief of the San Andreas National Guard (SANGuard). The Governor may call it forth, at his discretion, to execute the law, or during a State of Emergency.

Sec __ (a) Subject to application procedures provided by statute, the Governor, on conditions the Governor deems proper, may grant a reprieve, pardon, and commutation after sentence, except in case of impeachment. The Governor may not grant a pardon or commutation to a person twice convicted of a felony except on recommendation of the Supreme Court, 4 judges concurring. (b) No decision of the parole authority of this State with respect to the granting, denial, revocation, or suspension of parole of a person sentenced to an indeterminate term upon conviction of murder shall become effective for a period of 30 days, during which the Governor may review the decision subject to procedures provided by statute. The Governor may only affirm, modify, or reverse the decision of the parole authority on the basis of the same factors that the parole authority is required to consider.

Sec __ (a) The Lieutenant Governor shall become Governor when a vacancy occurs in the office of Governor. (b) The Lieutenant Governor shall act as Governor during the impeachment, absence from the State, or other temporary disability of the Governor. (c) The Supreme Court has exclusive jurisdiction to determine all questions arising under this section.

Sec __ (a) Subject to the powers and duties of the Governor, the Attorney General shall be the chief law officer of the State. It shall be the duty of the Attorney General to see that the laws of the State are uniformly and adequately enforced. The Attorney General shall have direct supervision over every district attorney and sheriff and over such other law enforcement officers as may be designated by law, in all matters pertaining to the duties of their respective offices, and may require any of said officers to make reports concerning the investigation, detection, prosecution, and punishment of crime in their respective jurisdictions as the Attorney General may seem advisable. Whenever, in the opinion of the Attorney General, any law of the State is not being adequately enforced in any county, it shall be the duty of the Attorney General to prosecute any violations of law of which the superior court shall have jurisdiction, and in such cases the Attorney General shall have all the powers of a district attorney. When required by the public interest or directed by the Governor, the Attorney General shall assist any district attorney in the discharge of the duties of that office.
